Susan's Legal Bits
In August 2009 Susan was interested in.....
....answering a question about holiday pay
Hello everyone. Well, this month it seems that everyone is going on holiday apart from me.....
Never mind, my long weekend in Bournemouth did the trick and a cheeky ice cream was had by all interested parties!
Over the last few weeks I haven't had many legal questions or subjects for me to rant upon from you but I did have a very interesting and unexpected query from the wife of someone using a competitor of ours. Essentially she was querying with me whether what this other umbrella company was doing with her hubby was legal.
I enjoyed getting to the bottom of her very detailed email and managed to decipher that this umbrella company was not accruing holiday correctly, only taking £1.48 tax on a gross of £287 and not taking nearly enough NI. At an admin fee of £11 she and I agreed that this umbrella company was obviously proving to be quite popular but 3 major areas of concern from my first read through has got to ring warning bells.
Obviously it is very difficult for me to give advice to people about providers other than Gabem but I am always happy to comment when provided with facts and figures so.............if you are not sure and are feeling the hairs on the back of your neck stand up because you just can't figure out why your take-home pay is so high and can still be legal......just drop me an email and let me know how I can help - alternatively I would recommend asking HMRC if your provider is taking the correct tax for you!
Finally, for the umbrella company out there that is paying out 30 hours holiday when an employee has quite clearly accrued 66.6 under the Working Time Regs I wonder if you need some advice of your own - if so please get in touch.
Happy holiday months everyone.
Susan Hickman, HR Manager at Gabem.
